What is probate?

Probate is the legal process by which the estate and assets of a person are transferred to the heirs. In the event of a death, the will is examined for validity by the probate court, any objections to the will are heard, and the assets are transferred to the heirs according to the wishes of the deceased. If no will is present, then the probate court will decide how to distribute the estate according to State law.
